Usps insurance claim/ ebay return question.
 
I know this is a bit off topic for a baseball card group but since there is no doubt expensive ebay and usps experience, I hope some one can give me some advice
I sold a WORKING alienware laptop on ebay last week. I shipped it and insured it for full cost priority shipping. It was shipped in besides a box with packing in w travel laptop bag.
It is being returned by the buyer who claims that claims the lcd screen on it no longer works. He initiated a return which ebay accepted and have to send him a return label. My question is supposing on return it was not tampered with and is infact broken, how likely it is and what I would need to file a successful insurance claim.

You may be able to win this one. Make sure that you save all of the original packaging and take photos of the box to see if the box was damaged.

USPS is very picky on these kind of claims. There have been many instances of people shipping broken laptops to a friend and then claiming insurance for damage.

Of course he didn’t send back the original box, and isn’t responding to messages. I had to open an eBay complaint, but I think I’m probably going to be out of luck. Probably was damaged in shipping most likely ironically...

Why didn't he file the claim on his end? he had the item and the packing material. I had to do that with a Royal Doulton figurine.

Can a buyer, who did not buy the insurance, make a claim for it ?

He finally did respond he said the box arrived “disfigured” but he signed and then threw out the box. He has a lot of feedback and seems to have a comp business on it. I am really disappointed, if it arrived damaged with his experience he shouldve known to either take pictures or save the box. He did neither.

Because he didn't save the packaging, you should have a good argument with ebay. I think you are out of luck with the post office since he didn't take pictures.

Ebay knows that a seller can't file for insurance with USPS without pictures.
