Would like some opinions on an eBay purchase

I have been picking up PSA slabbed unopened wax and cello packs from the '70s, football and baseball. Just received the '78 Topps baseball wax pack PSA 7 I purchased. The picture of the item on eBay, matching cert number of the one I received, shows a clean pack with no major issues visible. Upon receipt of the pack, it has a significant tear center top edge which is clearly visible from a straight on angle as in the pic, as well as another tear on the left edge where the tip of the gum was sticking through. It was well packaged. Any thoughts on whether it is worth it to address this? Is it a reasonably common appearance for movement during shipping to create tears in old packs? If I can figure out my new phone I will put pics up here, but, what it appears to me based on the pic provided on the item is that the pic was "cleaned up". The seller has 100% feedback, and I have purchased singles from them before. Just kind of stinks.
Updated: A couple of pics of the pack as received.

If what you received does not match what is pictured and you are not satisfied, you have the option to open a NAD case through ebay and return this item at the sellers cost for a full refund. Make sure you upload with the case a good picture clearly depicting the defects in case a live human on ebay becomes involved.

What is interesting is the same seller sold a different 78 PSA 7 pack back in April and the top edge of that pack has some noticeable wear.

OK, here are the pics of the pack as received. I'm assuming you looked at the pack on eBay through my user ID or sold history. If so, you can see the original pack and compare to my pics here. I saw that other pack and this one is different. Like I said, the cert number is the same, so the only answer I see is cleaning up the photo or damage in transit.

If the gum is loose, the damage could have happened in shipping and there wasn't much the seller could have done since its sealed.

Did you contact the seller? He should take it back and file a claim with USPS if insurance was bought.

Thanks to both of you for the thoughts. I have not contacted the seller yet, as I wanted to see what opinions I might find here. The possibility of it happening during shipping seems legitimate. But, I may go ahead and see where he stands on this.

My guess is that may have happened in shipping as the listing's image does not appear altered, etc. In addition, the pack he sold in April had some corner wear that was not photo shopped, so it is unlikely he would have altered one image and not the other. I would start with a message first and and if the seller is unwilling to help, move onto the NAD case.
