Nu-cards had lost a lawsuit brought by universal in 1961 for copyright infringement. This was the first domino to fall in them going under.
“U Wins Infringement Suit Against Nu-Cards, Korn NEW YORK — Universal Pictures’ suit against Nu-Cards, Inc., and Alexander Korn for copyright infringement of Uni- versal’s stills of scenes from certain of the company’s “horror-monster” pictures by Nu-Cards’ publication of miniature re- production of the stills as trading cards ended September 22 with the entry of a consent decree against the two defendants. Under the terms of the decree the de- fendants were permanently enjoined not only from reproducing the particular stills on Nu-Cards’ trading cards but also from reproducing any of the horror-monsters depicted on those stills in any form. Nu-Cards and Korn also consented to pay damages in the sum of $2,500 to Uni- versal, the plaintiff-copyright owner. The stills involved were from such Universal pictures as “Blood of the Vampire,” “The Man Who Couldn’t Die,” “Revenge of the Creature,” “Horror of Dracula,” “Abbott and Costello Meet Frankenstein” and “The Mummy.” Universal was represented by Sargoy & Stein, New York law firm, while Cowan, Liebowitz, Emmanuel & Latman repre- sented the defendants. “
