Adam, I hear you, but in the particular mess that Clemens was in, the whole point of finding a lawyer is to get his particular advice on how to navigate past the alligators. Maybe Clemens had a path he wanted to follow but ol' Rusty facilitated that. Had Clemens come to me with that gameplan I would have told him to either follow my completely opposite advice or to take a hike. After all, in a high profile situation such as Clemens was in a lawyer does not want to lose. Getting famous for being a loser is not the kind of fame any attorney wants. Rusty blew this one, big time. I've never seen such massive mistakes from the get-go in such an obviously clear situation. This one wasn't even hard to figure out how it would end up.

And if if was me I would not want to book a deck chair on the Titanic next to ol' Rog...but I guess he figured Clemens was hellbent on going forward, the money was good, and the advice was in writing so WTF, no malpractice risk, get some airtime and blame the client.
