Default eBay warning Battlefield auctioning 1952 Topps Mantle PSA 5, 53 Mantle PSA 8, Etc

And she has put up a 1979 opc Gretzky PSA 9, And a Bill Russell rc PSA 8. The 1980 Rickey Henderson PSA 10 that just completed a few days ago was a lifted scan. The card with that serial number was holdered in a new lighthouse label case and she ran the auction with old scan. Does not look good . She apparently is shipping these high dollar cards via FedEx to avoid mail fraud?

(1) 1980 Topps Henderson PSA 10 Heritage auctions May 2016 serial number ending with 74761- image at HA.com clearly shows newer hologram PSA flip. Sold for $38.240.

(2) 1980 Topps Henderson PSA 10 recently completed by Battlefield with the same serial number - realized price of $14,000- image/ scan used, has the same serial number, without the hologram on the flip- how can this be correct?? - when the card was reholdered.

Damn, there's a thought. I can create different accounts, sell tons of little bullshit items and then sell my ebay ID to someone else for lots of money so that they can bilk people.... Crap, I bet someone beat me to that idea...

Any lawyers out there: How is this not:
1} mail fraud
2} Theft by deception

I thought both are criminal offenses and why can't ebay be held accountable.

The bigger problem as I see it is VCP needs to void any sale battlefield does.
It's obvious many of us are not going to bid , thus they are gonna tank prices.
Is there anyone who is in contact with the vcp admin?

I think Section 230 of the Communications Decency Act protects ebay. Ebay is a venue much like this forum. Venues don't generally get held accountable because of that law. It defines who a publisher of information is and it protects venues in that respect.
I can't count how many times I have had to laugh at lawyers who sent me Cease and Desist letters for what others say on this board. I usually call them, laugh at them, tell them to study up a little, tell them to F-off and hang up. I have never heard from one again after that scenario. Unless ebay is complicit in the specific issue they probably can't be held accountable, generally speaking. Just like I can't be held accountable for what others say on this forum, legally speaking. I am obviously not a lawyer but that is my layman's take on the issue with ebay. As far as going after a bad ebay seller, it would probably need to start with who got ripped off and his local authorities. Federal authorities would have to be interested in the issue and that is not always an easy battle itself.

I simply did a google search for this card and this was the first image that appeared in the search.....too bad battlefield did not do a more extensive image search for this card or they would have realized that the card had been reholdered between the Mile High and Heritage auctions.
